Alhamdulillah! Another Victory for Employees Hired Under the Quota System
In a significant decision, the Lahore High Court has once again ruled in favor of employees recruited under Rule 17-A of the Punjab Civil Servants (Appointment & Conditions of Service) Rules, 1974. This rule provides special appointment rights to the family members of government employees who pass away or suffer permanent disability during service.
Background of the Case
Recently, the Punjab government refused to release the salaries of employees hired under Rule 17-A, arguing that the rule was abolished on the same day their appointments were made. The Accounts Department cited a notification issued on 24-07-2024 that allegedly removed Rule 17-A from the legal framework, using this as the basis to withhold salaries.
This decision deprived employees of their rightful earnings despite them performing their duties diligently. It was an unjust and unreasonable stance that created financial distress for the affected employees and their families.
Justice Khosa’s Victory in Court
To challenge this unfair decision, Justice Khosa took up the case, and I filed a writ petition in the Lahore High Court on behalf of the affected employees. During the proceedings, we argued that:
- The appointments were made lawfully under Rule 17-A before its alleged removal.
- The employees were already serving when the notification came into effect.
- The government had no legal grounds to deny them their salaries.
The Honorable Justice Anwaar Hussain of the Lahore High Court reviewed the case and dismissed the Punjab government's objections. The court ruled in favor of the petitioners and ordered the immediate release of salaries to the affected employees.
Significance of the Decision
This judgment is a landmark victory for government employees hired under Rule 17-A. It reaffirms that government policies cannot be applied retroactively to unfairly penalize employees who were legally appointed. The ruling ensures that no employee should suffer financial hardship due to administrative misinterpretations.
